Application Requirements

Income Requirements:

Arbours at Cane Creek is operated under Affordable Housing Program under Section 42 of the Internal Revenue Code. Residency at Arbours at Cane Creek is for those families having low to moderate incomes. The maximum allowable income (by family size) for the Anniston area is listed in the table below. Rents and income limits are subject to change without notice, pending HUD Updates.
 

Student Housing Eligibility LIHTC Compliance

This property participates in the Low-Income Housing Tax Credit (LIHTC) program, which restricts occupancy by full-time students. As such, a household comprised entirely of full-time students is not eligible for housing unless one or more of the following exceptions apply:

  • At least one member of the household is receiving assistance under Title IV of the Social Security Act (e.g., TANF).

  • At least one household member was formerly in the foster care program.

  • The household includes at least one student who is enrolled in a job training program receiving assistance under the Workforce Innovation and Opportunity Act (formerly the Job Training Partnership Act) or similar program.

  • The household consists of a married couple who are eligible to file a joint federal tax return.

  • The household is comprised of single parents and their children, where neither the parents nor the children are dependents of another individual.

All applicants must provide documentation to verify eligibility under one of these exemptions if the household includes only full-time students.
 

LIHTC Student Rule: Section 8-Based Exemptions

A household made up entirely of full-time students may still qualify for a LIHTC unit if at least one household member meets any of the following exemptions:

  1. Student is 24 Years Old or Older

    • The student has reached their 24th birthday.

  2. Married

    • The student is legally married.

  3. Has Dependent Children

    • The student has at least one dependent child living with them.

  4. Veteran of the U.S. Armed Forces

    • The student is a veteran who served in active duty (including National Guard/reserve units activated for federal service).

  5. Was in Foster Care

    • The student was an orphan, ward of the court, or in foster care at any time after turning age 13.

  6. Person with Disabilities Receiving Section 8 Assistance on or before November 30, 2005

    • The student is a person with disabilities and was receiving Section 8 assistance as of that date.

  7. Enrolled in a Job Training Program

    • The student is enrolled in a job training program receiving assistance under the Workforce Innovation and Opportunity Act (WIOA) or similar federal/state programs.

  8. Receives Section 8 Assistance

    • The student (or their parents individually or jointly) is eligible for Section 8 assistance or currently receiving it.

Gross income is calculated as income before taxes.

Income includes, but is not limited to, wages from employment, social security, pension, court ordered child support, unemployment, self-employment income (must be verified with previous tax return), and gift contributions (can only be 35% of qualifying income).
